The regulators have finally taken action requiring many lenders to provide remedies to victimized homeowners under a consent order.

FEDERAL GOVERNMENT SETTLES WITH LARGE LENDERS OVER WRONGFUL FORECLOSURE PRACTICES

Under a settlement between the federal government’s major regulators, Office of the Comptroller of the Currency (“OCC”) and Federal Reserve, and mortgage lenders, independent reviewers will review the homeowner’s file. They will determine if the homeowner suffered financial harm including not obtaining an affordable mortgage payment or losing their home resulting from lender caused errors, misrepresentations or other deficiencies.

The independent consultants will decide whether the homeowner should receive cash compensation up to $125,000, return of the foreclosed property or another remedy such as cancellation of the foreclosure.

Foreclosures are destroying the golden years for many senior citizens. Proof? Recent statistics from the American Association of Retired Persons revealed the following:

-About 3.5 million loans held by people over 50 (or 16 percent of all loans for that group) were underwater as of December 2011.

-The percentage of seriously delinquent mortgage loans increased from 1.1 percent in 2007 to 6 percent in 2011 for people 50 and older.

-The foreclosure rate for people 50 and older also increased, from 0.3 percent in 2007 to 2.9 percent in 2011

Fighting Foreclosure . . . and Stage 4 Breast Cancer  . . . that’s the plight of a North Carolina woman and her loving husband, who took a 55% pay cut so he could be close to home to be with her. Telling their story to several local and national outlets, the couple explained how they came to face foreclosure, ie:

Cindi Davis, 50, had to resign from her job as a school teacher to go on long-term disability. She said she has stage four cancer, now that it has spread to her lymph nodes, lungs and liver. Kirk, 51, left his job as a project manager in the automotive industry that required travel. He took a 55 percent pay cut for another job as a machine operator.

“I had to find something that was close to home and was grounded so when the opportunity came for chemo, I would be able to go,” he said.

Foreclosure Statistics: Lenders Foreclosed on Fewer Homeowners in August

Lenders didn’t foreclose on as many homeowners last month as in previous months. A few reasons account for this, as explained in the San Jose Mercury News article, Lenders ease off on foreclosure filings in August, which stated:

Lenders kept default filings down as they continued working out loan modifications or short sales — sale of a property for less than the amount of the mortgage — with struggling homeowners.

Those efforts have been boosted by a national mortgage settlement reached with five major lenders early this year, in which the lenders agreed to help struggling homeowners with principal reductions, loan modifications and other relief.
