Tis the season of politicking — the time when Americans get ready to elect new officials. And, this year is the BIG ONE — as in the nation is getting ready to vote on who they want to be/stay the President of the United States.

The article, Foreclosures Leave Holes In Voter Outreach, explains stating:

Today, three of the eight states with the highest foreclosure rates are presidential battlegrounds: Florida, Ohio and Nevada.

. . .. In the past four years, more than 3.7 million homes have been lost to foreclosure, [and] Organizers are discovering scores of vacated homes in key battlegrounds that contributed strong turnouts in the 2008 election.

This puts President Obama in a particularly precarious position because he won the three states mentioned above in the last presidential election. Furthermore, as the aforementioned article points out, voters are clearly frustrated with his handling of the foreclosure crisis (the economic crisis in general). Proof?

In Florida, Ohio and Nevada, Republican governors have been elected since the President was elected.

While the President has passed legislation to try to help ease the housing crisis, it’s been summarily criticized by housing experts and homeowners alike. The republican nominee, Mitt Romney, hasn’t put forth a plan to deal with the foreclosure crisis.

Where does this leave homeowners?

Right where many of them have been since the whole housing debacle started — waiting, wondering and hoping and praying.

Independent Foreclosure Review Deadline Looming: You May Have Money Coming If You’re Facing Foreclosure – Find Out Before It’s Too Late

ForeclosureBusinessNews.com: “Foreclosure News the Average Joe Can Use!” Find Trusted Vendors, eg, Foreclosure Lawyers, Mortgage Consultants, Cleaning Co’s, Etc.

A key deadline for homeowners facing foreclosure is December 31, 2012. What’s this deadline about? Well, part of the foreclosure settlement federal authorities reached with large mortgage servicers requires them to hire independent loan consultants to investigate foreclosure abuses and compensate homeowners who suffered financial harm.

The original deadline for homeowners to request a forensic audit of their mortgage paperwork was April 30th. It was then extended to July 31st. Now, it’s been moved again – to December 31, 2012.

Why the Deadline to Request an Independent Foreclosure Review Has Been Moved Again

Quite frankly it’s because so few homeowners have taken advantage of this offer. And, that’s mainly because many homeowners facing foreclosure don’t even know about it.

How Much Money Can You Get If an Independent Foreclosure Review Finds Infractions by Your Loan Servicer/Lender?

As we discussed in the post, The OTHER Foreclosure Settlement: You May Be Eligible to Be Paid TWICE – Even If You Didn’t Lose Your Home to Foreclosure:

It all depends on your circumstances, but you stand to get money back for even a single infraction if the independent “foreclosure consultants” discover that lenders committed a transgression during your foreclosure process.

An article on GlobalNation.com discussing this new deadline to request an independent foreclosure review put the figure at between $500 and $125,000, plus equity, stating:

If the review finds that financial injury occurred, the borrower may receive remediation such as lump-sum payments, suspension or rescission of a foreclosure, a loan modification or other loss mitigation assistance, correction of credit reports, or correction of deficiency amounts and records. Lump-sum payments can range from $500 to, in the most egregious cases, $125,000 plus equity, according to guidance issued by the agencies.

How to Request an Independent Foreclosure Review

So if you’re a homeowner facing foreclosure, you should definitely take advantage of this service. It’s FREE – and relatively easy to do.

Find out everything you need to know to request an independent foreclosure review.

I filed Chapter 7 bankruptcy, and all my debts listed were discharged; can the bank still foreclose?

ForeclosureBusinessNews.com: “Foreclosure News the Average Joe Can Use!” Find Trusted Vendors, eg, Foreclosure Lawyers, Mortgage Consultants, Cleaning Co’s, Etc.

Many homeowners still don’t quite get how bankruptcy works when it comes to foreclosures. A common question asked by many is if a bank can indeed foreclose on a home if it was discharged in bankruptcy. And, the short answer is . . .

Yes, a lender can foreclose on your home — even if the debt owed was discharged in bankruptcy.

Following is a recent question of this nature answered by a bankruptcy specialist in an article entitled Can Your Lender Foreclose After Bankruptcy on Fox Business News. The homeowner wrote:

I filed Chapter 7 bankruptcy, and all debts listed were discharged in 2008. The bank has just notified me of plans to foreclose on a home that was discharged. They plan to put it up for auction in September. Can they do that?

And again, the answer is yes. As the bankruptcy in the article explained, “[unless and/or] . . . until the property is back in the possession of the bank, you are still the legal owner of the property.

Foreclosures Fall as Recently Enacted Foreclosure Laws Make It More Difficult for Lenders to Take Homes Away from Homeowners

ForeclosureBusinessNews.com: “Foreclosure News the Average Joe Can Use!” Find Trusted Vendors, eg, Foreclosure Lawyers, Mortgage Consultants, Cleaning Co’s, Etc.

Foreclosures are falling across the U.S. On the face of it, this seems to be an encourage foreclosure statistics. But, the decrease is due to the fact that recently enacted foreclosure laws across the country are making it more difficult for lenders to actually foreclose on — and repossess homes — from owners who are behind on their mortgage payments. No more robosigning documents and bang, a homeowner is out.

A recent article on foreclosure filings in  The Washington Post explained, stating:

U.S. foreclosure filings fell 10 percent in July from a year earlier as court rulings and new legislation slowed the process for seizing homes in some states, according to RealtyTrac Inc. . . . Seizing properties from borrowers behind on their mortgage payments became harder as judicial decisions and recently enacted laws gave homeowners more ways to avoid foreclosure, RealtyTrac Vice President Daren Blomquist said in the statement.

So, what does this mean for the average homeowner?

Olympic Foreclosure! Gold-Medal Winner Ryan Lochte’s Parents Face Foreclosure

It seems that no one is immune from foreclosure notices these days — not even an Olympian (who’s  become somewhat of a celebrity because of his Olympic success).

Gold-medal winner Ryan Lochte’s parents face foreclosure on their Florida home. As reported via ABC News:

The parents of U.S. Olympic gold-medal swimmer Ryan Lochte cheered their son on in London this week, but they were also embroiled in a foreclosure lawsuit back home in the states.

CitiMortgage filed a suit against Lochte’s parents . . . seeking to foreclose on the couple’s February 2007 mortgage on their property in Port Orange, Fla. The bank is seeking to recover $250,000 . . . [Source: ABCNews.com, Lochte’s Parents Face Foreclosure on Port Orange, Fla., Home]
