Why It’s Important For Homeowners Facing Foreclosure to Know What MERs Is

In short, because now courts are challenging their ability to foreclose at all on a homeowner. Why? Because they don’t own an underlying interest in the property. 

Only a party with an “interest” in a property can file to have it foreclosed on (eg, a bank/lender, a contractor who has a lien against it, a homeowners association (HOA) when a home owner doesn’t pay their dues, etc.).

MERs’ position, by its own admission, was only to “keep track of changes in servicers and mortgage ownership . . . Foreclosure really was not central to [its] core business and the organization never received income from foreclosures.” 

So, what does all of this mean for the Average Joe homeowner?

Main that your home may have been illegally foreclosed on because the organization “helped make possible foreclosures that otherwise might not have taken place because the necessary original documents were missing,” according to the Reuters article, Exclusive: Facing criticism, MERS cuts role in foreclosures. 

What Should You Do If You’re a Homeowner Who’s Received a Foreclosure Notice from MERs

There are so many intangibles that it’s hard to lay out a specific course of action for every homeowner. Many lenders have their own programs where they’re trying to work with borrowers – so some are being proactive on their own.

But, if you suspect that your home was illegally foreclosed on and you can’t get any cooperation from your lender, it might be time to consult a foreclosure attorney to at least discuss your options – that is, if you even want to keep your home.

As explained in The New York Times article, The Banks Still Want a Waiver, MERS is the acronym for:

. . . the Mortgage Electronic Registry Systems . . .  This company, owned by the major banks, was set up in the mid-1990s by the Mortgage Bankers Association, Fannie Mae and Freddie Mac. Its goal was to expedite the home loan process. . . . By eliminating the need to record changes in property ownership in local land records, MERS ramped up profits for lenders. In 2007, MERS calculated that it had saved the industry $1 billion over 10 years. An estimated 60 percent of all home loans were registered to MERS. 

MERS has issued foreclosure notices. But, some courts are saying that they don’t have the authority to because they don’t have an ownership interest in the properties; they only, in essence, played an administrative role.

If this sounds like another form of “robosigning”, you’re not far off – and courts around the nation are starting to agree, especially as the practice is continuing, in spite of the fact that many banks stopped foreclosing on homes last fall until they could get their “houses in order” (pun fully intended).

In the June 2011 article, Special Report: Banks still robo-signing (a must-ready for every homeowner facing foreclosure by the way), by Reuters, an investigation by the respected journalistic outlet found:

. . .  that loan servicers are still using the corner-cutting tactic that most captured the public imagination last year: robo-signing. . . . The investigation identified six known robo-signers who have continued to churn out large numbers of mortgage assignments since the beginning of 2011 – months after the industry vowed to stop the practice.

So while banks still continue to cut corners, and the legal system seems to be finally taking steps to stop some of this madness, the most obvious question is . . . .

What options does this leave for “the Average Joe homeowner?”

Quite simply, hold on and sit tight until the courts figure it out. It probably won’t change your situation that much (after all, if you can’t pay your mortgage and you can’t get a mod from your lender, you’re probably going to lose your home) . . . but, until all the legal wrangling is done, it migh give you time to get your finances together to figure out your next move, ie: 

Continue to try to work out a deal with your lender to stay in your home (get a home loan modification); 

Go through (Chapter 7) bankruptcy to try to stave off foreclosure;

Voluntarily walk away from your home;

Do a deed in lieu of foreclosure; and/or 

A short sale.

Request for Proposals / Bids Requested: Important Tip to Remember

Various factors can change related to any of the above (eg, pre-bid meeting dates, contract stipulations, scope of projects, etc.). Hence, just because the deadline may have passed for a “mandatory” bid meeting, or even the date to submit your bidd, contact the applicable agency to see if you can still submit. These contracts can run into the hundreds of thousands or millions of dollars (which can catapult your business to the next level) with the stroke of a pen, so it pays to check out every contract you even think you might be eligible for.

Shocking (Or Maybe Not So Much) Home Foreclosure Statistic

According to the June 2011 CNN Money article, Walk away from your mortgage? Time to get ‘ruthless’:

. . . a recent survey by home finance company Fannie Mae found that while only about 27% of homeowners would even consider walking away, that’s up from 15% last year. . . [and] Jon Maddux, CEO of YouWalkAway.com, reports 10% more clients this year to his company, which advises people how best to handle the walk away process.

Home Foreclosure: Time for Banks to Get Serious about Home Loan Modifications, Writing Down Principals and REALLY Working with Homeowners in Earnest — be Prepared to Get in the Business of Selling Real Estate

Many homeowners are getting laser specific about where they stand financially – and how to get through this mess. And, many of them are tired . . .

Tired of waiting for a bank to get back to them with an answer on their home loan modification request;

Tired of having to submit the same paperwork over and over again;

Tired of being transferred from one foreclosure specialist within a big bank to another – only to have to begin the process all over again when a new “specialist” is assigned; and

Tired of receiving  options that do nothing to really help them hang onto their homes – only delay the inevitable (foreclosure).

And . . .

Yeah, Americans need to learn to live within their means.

Yeah many signed on for mortgages they could afford; and

Yeah many should lose their home to foreclosure.

But this is all water under the bridge and we need to be focused on home foreclosure solutions because it hits us ALL in the pocketbook, not who did what wrong 5 years ago.

The Bloomberg.com article, Mortgage Principal Write-Downs Lagging, sums it up brilliantly, stating:

There was a lot of money put into rescuing the banks and not nearly the resources put into rescuing regular folks,” said Bruce Mirken of the Greenlining Institute, an economic policy group in Berkeley, California. “A fair number of these loans were written based on fantasy values. It’s better for everybody concerned to have a mortgage market and a housing market that has some connection to reality.

Finally, someone laid it out in plain language!

If banks don’t come to their senses soon — as homeowners have started to – we’ll still be in this same foreclosure mess of a crisis 5 years from now. Can your wallet/property value weather that?

When the foreclosure crisis started in the fall of 2007, new home builders were some of the hardest hit – and they remain so. According to the article, Housing Starts in U.S. Probably Rose in June for Second Month, although housing starts are up by a little as of May (2.4%), it’s when you look at building permits that the real story can be told. Why? As the aforementioned article states:

Building permits, an indicator of future projects (emphasis added), fell 2.3 percent [in May] to a 595,000 rate . . . Declining home values and delays in processing foreclosures mean it may take years to clear the market of distressed properties, a sign a sustained gain in homebuilding will take time to unfold.

 But, some home builders are finding a bright spot in this foreclosure crisis – multi-family dwellings.

New Crop of Business for Builders: Rental Properties

 As more and more Americans lose their homes to foreclosure – either by choice, eg, doing the “jingle mail walk”, or those who stay until the bitter and have their home foreclosed on and sold on the courthouse steps, renting is becoming the new owning.

According to the AP article, Forecast: Homebuilders to focus on Calif. cities, states:

. . .building permits for single-family and multi-family dwellings had both fallen to about 20 percent their 2006 peaks in mid-2009. But multi-family permits have since recovered to about 40 percent of their peak level, while single-family permits continue to decline, . . .

The article also goes on to explain why this trend is likely to continue, noting that Generation Xers (those in their late 30s early/late 40s) are the ones who lived through (are living through) this current foreclosure crisis. And, as the age, many may be unable or even unwilling to give homeownership a go a second time around.

One can only speculate on the effect this has had on the children of Generation Xers. Seeing their parents lose homes, living through multiple moves, having to say goodbye to old friends and the stress of making new ones at new schools; watching the anxiety of their parents as they struggle – this generation may not as readily embrace home ownership as eagerly as their parents did.

All of these help to shed light on why multi-family dwelling construction will continue to grow in the coming years.
